Lawsuit accusing Denver’s dog food plant of being too stinky dismissed

Part of living in Denver is knowing that one portion of I-70 smells terrible thanks to the Nestle Purina pet food plant that’s been there since 1972. Yet, last year, some dude thought he’d make some money of the stench…

On May 28 of 2024, a class-action lawsuit was filed in the U.S. District Court of Colorado alleging that noxious fumes from the pet food plant are so bad that people who live nearby should be compensated for their loss of property value and quality of life.

On May 28 of this year, exactly a year later, his attorneys filed court paperwork seeking to voluntarily dismiss their complaint.

Records do not indicate exactly why the case was dismissed. A filing shows the parties in the case will handle their own attorney fees.

So, here’s a good reminder that if you chose to live in the general vicinity of the plant, it was there first, and it stinks, so be prepared to deal with it.
